The actions you take in the minutes, hours, and days following a Texas car accident can make the difference between a full recovery and a lifetime of financial struggle. Most people do not know what those actions are until it is too late. Whether the crash was minor or catastrophic, the steps you take immediately after matter enormously to both your health and your legal rights. Here is the guide we wish every Texan had before they ever needed it.

1. Check for Injuries and Move to Safety

Your first priority is safety. Check yourself and your passengers for injuries. If it is safe to do so, move vehicles out of active traffic. Activate your hazard lights to warn other drivers. If anyone is seriously injured, do not move them unless there is an immediate danger such as fire.

2. Call 911 Immediately

Texas law requires you to report accidents involving injury, death, or significant property damage. Call 911 even if injuries seem minor. You need an official police report. When officers arrive, give them accurate information but avoid speculating about fault or saying anything like 'I did not see them' that could be misinterpreted.

3. Document Everything at the Scene

Use your phone to photograph all vehicles involved, the damage, the license plates, the road conditions, weather, traffic signals, skid marks, debris, and any visible injuries. Take wide-angle shots and close-ups. You cannot take too many photos.

4. Exchange Information Properly

Collect the other driver's full name, insurance company, policy number, driver's license number, and vehicle registration. Get the names and contact information of all witnesses. Note the responding officers' names and badge numbers and request the incident report number.

5. Seek Medical Care That Same Day

Even if you feel fine, go to an emergency room or urgent care facility. Adrenaline suppresses pain. Many serious injuries including whiplash, concussions, and internal injuries do not present obvious symptoms immediately. Delaying medical care gives insurers grounds to argue your injuries were not accident-related.

6. Do NOT Post Anything on Social Media

This surprises many people but it is one of the most important rules. Do not post photos of the accident, comments about the crash, or anything suggesting you are feeling well or engaging in physical activities. Insurance investigators routinely monitor social media and will use your posts against you in ways you cannot anticipate.

7. Notify Your Own Insurance Company

Report the accident to your own insurer promptly, as your policy requires. However, you are not obligated to give a detailed recorded statement until you have spoken with an attorney.

8. Do Not Accept Any Early Settlement Offers

If the other driver's insurance company calls you with a quick settlement offer, do not accept it without consulting an attorney first. Early offers are almost always far below the true value of your claim, especially when the full extent of your injuries is not yet known.

9. Keep a Detailed Injury Journal

Every day, write down how you are feeling, what pain you are experiencing, what activities you cannot do that you could do before, and how your injuries are affecting your work, relationships, and daily life. This contemporaneous record becomes powerful evidence of your pain and suffering damages.
